Hyland lawsuits...

Since many of Dance Moms viewers have a continued interest in the lawsuit of Kelly and Paige Hyland AND the assault charges against Kelly, I did a little digging.

A lawsuit was filed in Paige's name as plaintiff against Abby on October 9th or 10th, one or two days before the season-opening competition. (Season 5) The lawsuit's first and only cause of action stated: "16. Defendant MILLER intentionally engaged in conduct that caused Plaintiff PAIGE HYLAND to reasonably believe that she was about to be touched or harmed in an offensive manner, namely by hit by [sic] a chair thrown by MILLER." A previous lawsuit had been filed in February, by lawyers (the same as above) representing Kelly, Paige and Brooke as plaintiffs. By mid-August, Judge Ruth Ann Kwan had announced her likely dismissal of the Hyland's claims on intentional and negligent emotional distress against Kelly's daughters, as well as claims of defamation; but was more likely to allow a trial on contractual matters. The judge later followed through on those intentions on November 17. The same judge also made simultaneous (but somewhat inconsistently reported) rulings in regards to permitting a trial in Paige's October lawsuit, in being allegedly assaulted with a chair.

So, Paige's trial is allowed to proceed SO FAR for the very same allegations that got dismissed when the court date was approaching. MY interpretation is that, in the most likely circumstances, the judge will dismiss Paige's suit, as well.
